1. Agreement to Terms
These Terms of Use (“Terms”) constitute a binding agreement between you (“User,” “you”) and CHARLES DEMICHER (“Company,” “we,” “us,” “our”). By accessing or using this website (“Site”), you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site immediately.
2. Heritage and Identity Notice
For more than three centuries, the Demicher lineage has maintained a documented heritage of leadership, service, and community contribution. In 1686, Valentino Demicher was granted a Coat of Arms and descriptive parchment directly by Leopold I, Holy Roman Emperor, in recognition of his management of operations and his protection of communities during the Great Turkish War.
This heraldic symbol was later re?created and formally registered with the Canadian Heraldic Authority / Autorité héraldique du Canada, Office of the Secretary to the Governor General. These historical and modern heraldic representations — including any future derivative or successor heraldic designs — form part of the protected identity of CHARLES DEMICHER.
The Company continues this lineage through modern consulting practices grounded in integrity, innovation, collaboration, and global perspective. This heritage is acknowledged here solely to establish identity, continuity, and intellectual property rights. Unauthorized use, reproduction, imitation, misrepresentation, or modification of any heraldic symbol, historical narrative, or identity element associated with the Demicher lineage is strictly prohibited.
3. Privacy Policy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how information is collected, used, and protected, including measures taken to safeguard the integrity of the Company’s identity, heritage, and brand.
4. Governing Law and Jurisdiction
These Terms are governed by the laws of the United States and the State of California, without regard to conflict?of?law principles. Although the Site may be accessible worldwide, you agree that any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.
5. Eligibility and Age Requirement
You must be at least 18 years of age to use this Site. By accessing or using the Site, you represent and warrant that you meet this requirement.
6. Communications, Information Requests, and Appointments

7. Brand, Name, and Identity Protection
7.1 Protected Names and Derivatives
The names “CHARLES DEMICHER”, “DEMICHER”, and all related derivatives, variations, alternate spellings, stylizations, translations, phonetic equivalents, abbreviations, and confusingly similar forms — whether written, spoken, digital, symbolic, or graphical — are protected identifiers of the Company and its founder.
Unauthorized use, imitation, misrepresentation, registration, or exploitation of any such identifiers, including but not limited to domain names, social media handles, usernames, business names, or other digital or physical identifiers, is strictly prohibited and may result in legal action.
7.2 Protected Slogans and Brand Identifiers
The following slogans, descriptors, and brand identifiers are protected intellectual property of CHARLES DEMICHER:

These, together with the Demicher Coat of Arms (1686), the Canadian Heraldic Authority registration, and any future heraldic or symbolic designs, are protected under applicable trademark, copyright, and unfair?competition laws. Unauthorized use, reproduction, imitation, or exploitation is strictly prohibited.
8. Intellectual Property Rights
8.1 Site Content
All content on the Site, including but not limited to text, graphics, images, logos, heraldic symbols, icons, audio, video, software, and layout (collectively, “Content”), is owned by or licensed to the Company and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, modify, distribute, display, perform, publish, create derivative works from, or otherwise exploit any Content without our prior written consent, except as expressly permitted by these Terms or applicable law.
8.2 No License
Nothing in these Terms or on the Site shall be construed as granting any license or right to use any trademark, service mark, heraldic symbol, logo, trade name, or other proprietary identifier of the Company, except with our prior written permission.
9. User Content and Submissions
If you submit, upload, or transmit any content, information, or materials to the Site (“User Content”), you represent and warrant that you have all necessary rights to do so and that such User Content does not infringe any third?party rights.
By submitting User Content, you grant the Company a non?exclusive, worldwide, royalty?free, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform such User Content in connection with the operation, improvement, or promotion of the Site and our services.
You remain solely responsible for your User Content.
10. Prohibited Conduct
You agree that you will not, directly or indirectly:
attempt to gain unauthorized access to the Site or related systems
probe, scan, or test vulnerabilities
interfere with Site functionality
introduce malware or harmful code
impersonate the Company or any associated individual
misrepresent your affiliation
attempt to hijack, redirect, or interfere with the Company’s domain or digital presence
infringe intellectual property rights
harass, threaten, or abuse any person
engage in unlawful, fraudulent, or malicious activity
Any such conduct constitutes a material breach of these Terms and may result in termination of access and legal action.
11. Prohibition on Defamation and False Statements
You may not publish, transmit, submit, or distribute, through or in connection with the Site or in reference to the Site, any content or statement that is defamatory, libelous, slanderous, knowingly false, misleading, or malicious regarding:

the Demicher family heritage or lineage
the Demicher Coat of Arms or heraldic identity
the Company’s services, reputation, or business relationships
any associated individuals acting in good faith
Any such conduct constitutes a material breach of these Terms and may result in legal action, including claims for damages and injunctive relief.
12. International Use
The Site may be accessed globally. Users accessing the Site from outside their jurisdiction do so voluntarily and are responsible for compliance with local laws. Regardless of location, these Terms are governed by California law as set forth in Section 4.
13. Third?Party Links and Resources
The Site may contain links to third?party websites or resources. These are provided for convenience only. We do not control, endorse, or assume responsibility for any third?party sites, content, products, or services. Your use of third?party sites is at your own risk.
14. No Warranties
The Site and all Content are provided on an “as is” and “as available” basis, without any warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non?infringement.
We do not warrant that the Site will be uninterrupted, secure, or error?free, or that any defects will be corrected.
15. Limitation of Liability
To the fullest extent permitted by law, the Company and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of or inability to use the Site, even if advised of the possibility of such damages.
In no event shall the total liability of the Company for all claims arising out of or relating to these Terms or the use of the Site exceed the amount, if any, paid by you to the Company for access to the Site during the twelve (12) months preceding the claim.
16. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

17. Ethical Mission Notice
The Company may, at its sole discretion, support or contribute to ethical, community?based, or sustainability?focused initiatives, including but not limited to projects related to community development, wildlife, ecological balance, and collaborative improvement of living standards. Any such activities are voluntary and do not create any obligation, partnership, fiduciary duty, or enforceable expectation on behalf of Users or the public.
